By accessing or using the Road511 API, website, developer portal, routing services, or any other related services (collectively, the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you may not use the Service.
Road511 is a sole proprietorship owned and operated by Roman Kotenko (“Road511,” “we,” “us,” or “our”).
If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms. In that case, “you” and “Customer” include that organization.
Road511 provides a REST API and related services that aggregate, normalize, classify, and process publicly available transportation, traffic, road-condition, work-zone, restriction, and related government data from North American 511 systems and other data sources.
The Service may include:
Road511 combines data from multiple sources into a common data model. The Service may therefore contain information originating from different providers and subject to different rights, licenses, conditions, and attribution requirements.
To use the API, you must create an account and obtain an API key, unless Road511 expressly permits otherwise.
You agree to:
You may not share your API key or account credentials with another person or organization except as expressly permitted by Road511 in writing.

Nothing in these Terms prohibits you from incorporating Road511 Normalized Data into your own products, applications, services, analytics, operational systems, or workflows, or from making information derived from or incorporating such data available to your own end users, provided that you comply with these Terms and all applicable upstream source conditions.
Permitted product use may include, for example:
Unless Road511 has expressly granted additional downstream redistribution rights in writing, your subscription does not grant you the right to resell, sublicense, publish, distribute, or otherwise make Road511 Data available as a standalone or substantially equivalent:
This restriction applies whether the data is redistributed unchanged or has been reformatted, renamed, reorganized, minimally modified, or combined with a small amount of additional information.
For clarity, a Customer Product that uses Road511 Normalized Data as an input or component is not, by itself, a prohibited competing data service merely because the Customer Product displays information derived from Road511 data.
If you require the right to provide Road511 Data itself to third parties as a standalone feed, API, database, or substantially equivalent data service, you must obtain a separate written agreement or other express authorization from Road511.
The Service is offered under tiered subscription plans. Details of each plan, including pricing, rate limits, quotas, and included functionality, are listed on the Road511 website or in your applicable order or subscription.
We may add new features, additional capacity, or expanded functionality to a plan, or otherwise enrich what a plan includes, at any time and without prior notice. Such improvements take effect immediately and require no action on your part.
Where we intend to materially reduce or remove a feature or functionality from a plan, or increase the price for existing subscribers, we will provide at least 30 days' advance notice by email and by notice on the website.
Such a change takes effect at the start of your next renewal period and will not apply retroactively or mid-period. If you do not wish to accept the change, you may cancel your subscription before it takes effect. Continued use of the Service after the effective date constitutes acceptance.
Where your subscription plan includes truck-routing, you may submit an origin, destination, optional waypoints, and a truck profile, including dimensions, weight, axle count, and hazmat class, to the routing endpoint and receive an optimized truck-legal route enriched with Road511 traffic, work-zone, restriction, and related data along the path.
HTTP 429 Too Many Requests with an error response identifying the applicable limit and reset time.Truck routing is intended as a planning and decision-support tool. You must not rely on a routed path for safety-critical or life-safety decisions without independent verification by a qualified driver, dispatcher, or other appropriate professional.
Road511 traffic, work-zone, restriction, and related data may be incomplete, inaccurate, delayed, or out of date for a particular vehicle, route, or operating condition.
Routing-call top-up packs are one-time purchases that grant additional routing calls in addition to the monthly subscription quota.
For convenience, the routing endpoint may automatically persist the inputs and computed result of a routing request to your account for a limited period (the “auto-save TTL”).
During the applicable TTL window, you may re-fetch the route and refresh its enrichment overlays without consuming an additional routing call where the Service supports such functionality.
After the TTL expires, the automatically saved route may be deleted and may no longer be available for re-fetching.
You may explicitly persist a route for longer where the Service provides such functionality. Persistent routes are retained in accordance with the Road511 Privacy Policy.
Road511 does not guarantee that enrichment overlays refreshed after the original routing request remain current. Traffic, work-zone, restriction, and other transportation information changes continuously.
You are responsible for independently verifying information where current conditions are material to a safety-critical or operational decision.
Road511 may offer a free trial of selected plans or features. The trial currently offered is described on the Road511 website and in the developer portal.
Unless expressly stated otherwise:
One trial per person or organization. The free trial is offered once to each person and to each organization. Registering additional accounts in order to obtain a further trial period, to reset a quota, or otherwise to obtain access beyond what your plan provides, is a circumvention of the technical limits of the Service under Section 4 — including where each individual account is separately registered, separately verified, or used in turn rather than at the same time.
Road511 may terminate or restrict trial access, and may suspend or close the accounts concerned, in cases of abuse, excessive automated usage, circumvention of limits, registration with information that is not accurate and complete as required by Section 3, or other violation of these Terms.
Recurring subscription payments are non-refundable for business users except where otherwise required by applicable law or expressly provided in the Road511 Refund Policy.
You may cancel your subscription at any time, and access will generally continue until the end of the current paid billing period. No pro-rata refunds are provided for partial months unless required by applicable law.
See the Road511 Refund Policy for additional terms governing subscription cancellations, annual plans, withdrawal rights, and top-up purchases.
The existence or exercise of any mandatory statutory cancellation, withdrawal, or refund right is not waived by these Terms.
Road511 aggregates and normalizes data obtained from publicly available government 511 systems, state and provincial departments of transportation, federal data services, open-data platforms, and other transportation-related sources.
Road511 does not claim ownership of underlying source data merely because Road511 accesses, aggregates, normalizes, or processes that data.
Rights in underlying source data remain with the applicable government agency, data provider, licensor, contractor, vendor, or other rights holder.
For purposes of these Terms, “Road511 Normalized Data” means transportation information processed by Road511 into Road511's common data model through activities such as extraction, normalization, classification, mapping, deduplication, aggregation, geospatial transformation, field mapping, and other processing.
Road511 Normalized Data may contain facts or other information originating from upstream sources. The existence of Road511 normalization does not by itself eliminate rights or contractual conditions applicable to underlying source material.
Road511 does not represent that every item of information available through the Service is subject to unrestricted commercial use, redistribution, sublicensing, or downstream dissemination.
You are responsible for reviewing and complying with the applicable license, attribution, notice, and usage requirements associated with the source data you receive through the Service.
Each upstream provider's applicable terms, licenses, attribution requirements, and other conditions continue to apply to downstream use to the extent applicable.
Notable upstream sources may include, without limitation, state and provincial 511 systems, federal transportation datasets, Statistics Canada, OpenStreetMap contributors, Work Zone Data Exchange feeds, and other government or third-party sources.
The source catalogue published by Road511 identifies applicable source information and attribution requirements where available.
Where an upstream source requires attribution, you must preserve and display the required attribution in the manner required by that source.
Where Road511 provides source attribution, credits, disclaimers, or notices in an attribution block or other metadata accompanying an API response, you must not remove or obscure them when you use or display the corresponding data in a manner where the applicable source requires their preservation or display.
For customer-facing products, attribution must be presented in a reasonably visible and appropriate location consistent with the applicable source requirements.
Attribution alone does not grant a right to use, reproduce, redistribute, sublicense, or commercially exploit data where the applicable source terms do not otherwise provide that right.
Some upstream providers require Road511 to pass their conditions on to recipients of their data.
Accordingly, you agree that you will:
Every API response carries the applicable per-source credit, and where a source requires one its disclaimer, in the attribution block; the full catalogue is published at /data-sources. Those texts are the conditions referred to above and must travel with the data.
Some upstream providers require Road511 to identify to them, by name, the intermediate and third-party disseminators who receive their data through the Service, and to keep that information current. Road511 cannot meet that obligation unless you tell us.
Accordingly, if you make source data received through the Service available outside your own organization — by redistributing, reselling, sublicensing, or publishing it, or by providing it through a product or service used by persons who are not your personnel — you agree to:
Road511 may disclose that information to an upstream provider where that provider's terms require it. Road511 will not disclose your pricing, your request volumes, or the identity of your own customers for this purpose unless an upstream provider's terms specifically require it and Road511 has told you so beforehand.
Failure to provide or to update this information is a breach of these Terms and may be treated as grounds for suspension under Section 13.
Road511 may receive source material that contains more than factual transportation information, including descriptive text, photographs, video, maps, logos, trademarks, or other expressive material.
Unless expressly authorized, you should not assume that a general right to use Road511 Normalized Data grants a right to reproduce or redistribute such source-specific expressive material.
Where Road511 identifies specific source material as subject to additional restrictions, those restrictions apply.
The Service is provided on a best-effort basis.
Unless you have a separate written SLA with Road511, we do not provide a contractual uptime guarantee or commit to a specific uptime percentage.
We operate the platform with commercially reasonable diligence, including monitoring, circuit breakers, heartbeats, and alerting, but the Service may be temporarily unavailable because of:
When an upstream source is unavailable, the corresponding Road511 endpoint may return empty results, partial results, or cached information where technically available.
Enterprise customers may separately negotiate a written SLA specifying uptime targets, response times, support obligations, and service credits.
The base Starter and Pro plans do not include an SLA unless expressly stated otherwise.
The truck-routing endpoint may depend on third-party upstream providers for path computation or related services.
Road511 does not guarantee 100% uptime for the routing endpoint and may return HTTP 502 routing_unavailable or another appropriate error during upstream outages, throttling, maintenance, or other upstream failures.
An outage caused by an upstream provider will not, by itself, constitute a material failure of a separate non-routing SLA unless the applicable written SLA expressly provides otherwise.
The Service, including its software, API design, API schema, documentation, developer tools, website, branding, interface, taxonomy, data model, normalization methods, processing logic, and other proprietary components, is the intellectual property of Roman Kotenko or the applicable rights holder.
These Terms do not transfer ownership of the Service or its proprietary components to you.
Subject to these Terms and your applicable subscription plan, Road511 grants you a limited, non-exclusive, non-transferable right to access and use the Service.
Except as expressly permitted by these Terms or a separate written agreement, you may not copy, reproduce, reverse-engineer, commercially exploit, or create a competing service from Road511's proprietary software, API implementation, documentation, or other proprietary components.
Road511 does not claim ownership of facts or underlying source data solely because they are accessed or processed through the Service.
To the maximum extent permitted by applicable law, Road511 and its owner shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenues, data, business opportunities, goodwill, or anticipated savings, arising out of or relating to your use of or inability to use the Service.
To the maximum extent permitted by applicable law, Road511's total aggregate liability for all claims arising out of or relating to the Service shall not exceed the amount actually paid by you to Road511 for the Service during the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
To the maximum extent permitted by applicable law, the Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, statutory, or otherwise.
Road511 specifically does not warrant that:
Without limiting the foregoing, transportation and traffic information may be delayed, incomplete, inaccurate, stale, or inconsistent with actual road conditions.
You are responsible for independently verifying information before relying on it for safety-critical, life-safety, regulatory, or other high-consequence decisions.
To the maximum extent permitted by law, Road511 disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, except to the extent such disclaimers are prohibited by applicable law.
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Road511 and Roman Kotenko from claims, liabilities, damages, losses, costs, and reasonable expenses arising out of or relating to:
This obligation does not require you to indemnify Road511 for claims caused solely by Road511's own gross negligence, willful misconduct, or other liability that cannot lawfully be shifted to you.
Road511 may suspend or terminate your access to the Service for:
Where reasonably practicable, Road511 may provide notice and an opportunity to cure a curable violation before termination.
Upon termination:
Termination does not automatically terminate rights or obligations that by their nature should survive termination, including provisions concerning intellectual property, source conditions, confidentiality where applicable, limitations of liability, indemnification, and dispute resolution.
We may modify these Terms from time to time.
Material changes will be communicated by email and by notice on the Road511 website at least thirty (30) days before they take effect, except where a shorter period is reasonably necessary because of legal, security, regulatory, or urgent operational requirements.
If you do not agree to a material change, you may cancel your subscription before the change takes effect.
Continued use of the Service after the effective date of an updated version constitutes acceptance of the updated Terms.
The version of the Terms applicable to a particular subscription or transaction is the version effective at the relevant time, subject to any separately agreed written terms.
These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-law principles.
The parties will first attempt in good faith to resolve any dispute arising out of or relating to these Terms or the Service through direct negotiation.
If the dispute cannot be resolved through good-faith negotiation, it will be resolved through binding arbitration, except to the extent applicable law gives either party a non-waivable right to bring a particular claim in court.
Nothing in this section prevents Road511 from seeking temporary, preliminary, or injunctive relief where necessary to protect its intellectual property, confidential information, Service infrastructure, API credentials, or other legitimate interests.
These Terms, together with any applicable order, subscription terms, written SLA, and other written agreement expressly incorporated into the Service, constitute the agreement between you and Road511 concerning the Service.
If a separately signed written agreement conflicts with these Terms, the signed written agreement controls to the extent of the conflict.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.
Road511's failure to enforce a provision of these Terms does not constitute a waiver of its right to enforce that provision later.
You may not assign or transfer your rights or obligations under these Terms without Road511's prior written consent, except as part of a merger, acquisition, or sale of substantially all of your assets where the successor agrees to be bound by these Terms.
Road511 may assign these Terms in connection with a merger, reorganization, sale of substantially all assets, or transfer of the Service.
Road511 is not responsible for delay or failure to perform caused by circumstances outside its reasonable control, including upstream service failures, internet or telecommunications failures, infrastructure outages, government actions, natural disasters, war, civil unrest, labor disputes, or other force majeure events.
